1. ROAD CONTROL

Drivers are required, at the request of the road policeman, to hand over the identity document or, as the case may be, the driving license, the registration or matriculation document of the vehicle being driven, the documents related to the goods being transported, as well as other documents provided by law.

Failure to comply with the obligation to have the documents in question, the refusal to hand them over to the police officer, the absence of the medical kit, of the reflective triangles and of the fire extinguisher (approved endowments), represent contraventions and are sanctioned according to the legal norms in force. 2. WEARING SAFETY BELTS AND CHILDREN’S TRANSPORTATION

Drivers and occupants of seats provided by the manufacturer with approved safety belts or devices must wear them during traffic on public roads, except as provided by road regulations. Drivers of vehicles having seats provided by the manufacturer with safety belts must inform passengers about the legal obligation to wear them during traffic on public roads. Drivers are required to ensure that, while driving the vehicle, minors wear safety belts or are transported only in approved child restraint devices, under the conditions laid down in the road regulations. Drivers are prohibited from transporting children up to 3 years of age in vehicles that are not equipped with safety systems. Children over 3 years of age, up to 150 cm in height, can be transported in vehicles that are not equipped with safety systems only if they occupy, during transport, any seat other than the front seat. 3. LEGAL SPEED LIMIT

On the Romanian territory, the vehicle driver must comply with the legal speed regime and adapt it according to the road conditions, so that he / she can perform any manoeuvre safely.

The maximum speed limit in localities is 50 km/h.

The maximum speed limits outside localities are:

highways 130 km/h;

expressways or national European roads (E) 100 km/h;

4. REGISTRATION CERTIFICATE RETENTION MEASURE

The matriculation or registration certificate or its substitute proof is withheld by the road police in the following cases:

1. the registered vehicle has not undergone the valid periodic technical inspection or it is cancelled;

2. the constructive technical norms regarding the transport of dangerous products are not observed;

3. the vehicle travels at night without headlamps or signalling lamps, lighting and light-signalling devices, fluorescent-reflective means, provided in the technical norms in force;

4. the vehicle travels with major or dangerous deficiencies to the lighting-signalling systems or with devices other than those approved;

5. the service braking system presents major or dangerous deficiencies;

6. the security or parking braking system presents major or dangerous deficiencies;

7. the steering mechanism presents major or dangerous deficiencies;

8. the tires have dimensions or characteristics other than those provided in the vehicle identity card, the tyre cord has cuts or creases, or are worn out beyond the legally allowed limit;

9. when traveling on public roads covered with snow, ice or glaze, the vehicle is not equipped with winter tires;

10. the noise while travelling or when parked exceeds the legal limit for the respective type of vehicle;

11. the engine emits polluting noxae above the legal limits allowed;

12. the windscreen, rear window or side windows of the vehicle display advertisements or posters, non-approved and / or improperly marked films or accessories that restrict or diminish the visibility during the ride, both inside and outside;

13. the front and / or rear of the vehicle displays posters, inscriptions or advertisements that diminish the effectiveness of the lighting and light signalling devices or the visibility of the registration number;

14. the vehicle has significant leakage of fuel or lubricant;

15. the registration or matriculation number plates are not in conformity with the standard or have lighting devices applied other than the approved ones;

16. the data in the registration or matriculation certificate do not correspond to the vehicle technical characteristics;

17. the vehicle is not insured for civil liability in case of damages caused to third parties by road accidents, according to the law;

18. the vehicle is missing one of the registration or matriculation number plates;

19. the vehicle is missing elements of the body or it is in an advanced state of degradation;

20. the registration of the vehicle is suspended, according to the law.

*The registration or matriculation certificate and the registration or matriculation number plates, except those that do not meet the standards, shall be returned to the owner or user of the vehicle by the road police, upon presentation by the owner or user of the proof of termination of the reason for which the document was withheld, under the conditions provided by the regulation, as well as at the end of the vehicle registration suspension.

*If the registration or matriculation certificate has been withheld as a result of a contravention regarding the driving on public roads of a vehicle with major or dangerous deficiencies, it shall be returned to the owner or the user by the road police upon presentation of the certificate issued by The Romanian Automobile Register showing that the deficiency has been remedied. 5. DRIVER’S LICENSE RETENTION MEASURE

The commission by the vehicle driver of the following deeds represents a contravention and is sanctioned with the fine stipulated in the second class of sanctions and with the application of the complementary civil sanction of suspension of the right to drive for a period of 30 days:

1. passing vehicle convoys stopped at the red light of the traffic light or at level crossings;

2. not granting crossing priority to pedestrians engaged in the statutory crossing of the public road through specially arranged and signalled places, on the direction of the vehicle;

3. not granting passing priority to vehicles that have this right;

4. failure to observe the significance of the red colour of the traffic light;

5. non-observance of the rules regarding passing;

5. non-observance of the signals, indications and dispositions of the road police officer who is in the exercise of his/her work duties;

7. failure to present oneself to the competent police unit on whose territory a traffic accident occurred, resulting in only material damages, except in cases provided by law;

8. if the holder of the driving license has committed contraventions that accumulate 15 penalty points.

 

The commission by the vehicle driver of the following deeds represents a contravention and is sanctioned with the fine stipulated in the third class of sanctions and with the application of the complementary civil sanction of suspension of the right to drive for a period of 60 days:

1. failure to comply with the rules regarding the crossing priority, passing or driving on the red light of the traffic light, if there was a traffic accident which resulted in the damage of a vehicle or other material damages;

2. non-observance of the temporary traffic ban established on a certain segment of the public road;

3. non-observance of the traffic rules when an official convoy is passing or interleaving such a convoy;

4. travelling in the opposite direction, except in cases where the passing manoeuvre is conducted according to the law;

5. if the holder of the driving license accumulates once more at least 15 penalty points in the following 12 months from the expiration of the last suspension of the right to drive.

 

The commission by the vehicle driver of the following deeds represents a contravention and is sanctioned with the fine stipulated in the fourth class of sanctions and with the application of the complementary sanction of suspension of the right to drive for a period of 90 days:

1. driving under the influence of alcoholic beverages, if the deed does not constitute a crime, according to the law;

2. driving the vehicle with dangerous deficiencies in the braking system or the steering mechanism;

3. failure to stop at the level crossing when the barriers or half-barriers are lowered or during the process of lowering or when the red light and / or audible signals are in operation;

4. exceeding by more than 50 km / h the maximum speed allowed on the respective road sector and for the category of the driven vehicle, ascertained, according to the law, with approved and metrologically verified technical means;

5. when the deed of the vehicle driver was prosecuted as an offense under the public road traffic regime, as well as in the case of the traffic accident which resulted in the death or personal injury of a person and the court or prosecutor ordered case closure, withdrawal of the criminal prosecution, waiver of the punishment application or postponement of the sentence application, if in the case of the violated traffic rule this emergency ordinance provides for the suspension of the right to drive.

*The penalty points are cancelled when the term of 6 months as of the contravention finding date is fulfilled.

*Suspension of the right to drive cancels all the penalty points accumulated up to that point. References: Road code 2019. GEO 195/2002, 2019 update

 

6. COLLISIONS (ACCIDENTS WITHOUT VICTIMS)

Drivers of vehicles involved in a traffic accident which resulted only in the damage of vehicles and / or other material damages are bound:

1. to immediately remove the vehicles off the road or, if the condition of the vehicles does not allow it, to move them as close to the curb or road shoulder as possible, signalling their presence;

2. to present themselves at the competent police unit in whose jurisdiction the accident occurred, within maximum 24 hours from the occurrence of the event, in order to prepare the finding documents.

*The following are exempt from the obligations regarding the presentation to the competent police unit:

- the vehicle drivers that conclude an amicable accident finding, according to the law (in which case it is necessary to inform the insurance company by telephone / e-mail);

- the vehicle driver who has an optional vehicle damage insurance, based on which he /she can be compensated, and the traffic accident resulted only in the damage of his /her own vehicle, without other damages. References: Road code 2019. GEO 195/2002, 2019 update

 

7. ACCIDENTS INVOLVING VICTIMS

The driver of a vehicle involved in a traffic accident that resulted in the death or injury of a person's bodily integrity or health is bound to immediately announce the police, not to modify or erase the traces of the accident and not to leave the crime scene.

Any person who is involved or is aware of a traffic accident that resulted in the death or injury of the bodily integrity or health of one or more persons, as well as in the case where a vehicle carrying dangerous goods is involved, is bound to immediately notify the police and call the unique national emergency number 112.

It is forbidden for any person to change the position of the vehicle involved in a traffic accident which resulted in the death or injury of the bodily integrity or health of one or more persons, to change the state of the place or to erase the traces of the accident without the approval of the police investigating the accident. 8. INSURANCE INFORMATION AND THE DAMAGE PROCEDURE

The insurance is compulsory for each rental and is concluded automatically without additional formalities when the driver fully pays the reservation in the Perpetoo Application. The Owner / Lessor does not have to pay anything to obtain the Insurance!

The insurance will become effective from the moment of delivery of the car to the Driver and is valid from the day and time of receipt until the day and time of handover, respectively the dates that were provided when the car was booked through the Application.

The insurance does not cover damages outside the rental period specified at the time of booking made through the Application.

The Driver, upon receipt, and the owner of the car / Lessor, upon return, will be required to take pictures of any damages, in order to be able to demonstrate their occurrence more easily during the rental period. This must be recorded in the delivery-receipt protocol (Annex 1 to the Lease agreement between the Lessor and the Driver).

The insurance covers the events related to: floods, hail, storm, earthquake, fire, explosion, collision, impact, objects falling, vandalism, theft. Damage caused to glass elements, rims and tires are also covered.

The insurance also includes free roadside assistance for vehicles up to 3,500 kg and / or up to 9 seats and no older than 7 years. If the car is between 7 and 10 years old, then the roadside assistance is not covered for technical faults, however it is valid for all the risks listed above.

The insurance also includes, in addition to the car insurance, the general accident insurance for the Driver and the persons inside the vehicle, however as mentioned, only for the rentals made through the Perpetoo Application and only for the reserved period. The risk of death and the risk of total or partial permanent disability are covered.

In the unfortunate event of an accident during the rental period, you will need to call 0374 40 04 00 to approve the damage and if the vehicle is not movable you can request the roadside assistance service at the phone numbers 021 201 90 62 or 031 730 99 62. 9. GUIDE ON APPROVAL OF THE CASCO DAMAGE FILE

The approval and opening of the damage files can be done by:

the insured person (Lessor);

its legal representative (of the Lessor);

the user of the asset (vehicle driver);

Step 1: For the approval and opening of a damage file at UNIQA Asigurări you have the following contact methods:

by e-mail at info@uniqa.ro with details on the event, the UNIQA policy / certificate series and your name;

the electronic damage approval form: https://www.uniqa.ro/daune/

by post, the documents being sent at the address: UNIQA Asigurări, 25 Nicolae Caramfil Street, District 1, Bucharest, Romania. You will be scheduled as soon as possible to ascertain the damages.

Step 2: Damage ascertainment: You will need to show up at the UNIQĂ branch office in your county or at the Damage Centre in Bucharest located at 2 Expoziției Boulevard, District 1 for damage ascertainment, with the following documents:

Identity card / identity document of the insurant or of the delegate (of the Lessor);

The driving license of the person who is behind the wheel during the event (copy of the driver’s driving license);

Certificate of registration of the damaged car;

Copy of the CASCO policy / certificate or knowledge of the number and series of the insurance policy / certificate;

Amicable ascertainment form / Minutes, Annex 2 or any other document issued by the police that shows how and when the event occurred and - if applicable - who is guilty of the damage; these documents must be presented in the original;

Power of Attorney / Mandate in case the owner / lessor cannot be present at the finding;

You can notify the damage by phone (UNIQA Call Centre 0374 40 04 00), by e-mail at info@uniqa.ro or online and you will receive the contact details of our partner Pilkington.

Go to the nearest Pilkington Windshield Centre * to open the damage, replacement or repair file. (* The service is available only in Romania.)

In case of thefts of / from CASCO insured motor vehicles:

Thefts of motor vehicles shall be immediately reported by calling the emergency service 112, after this call the damage will be notified at UNIQA Asigurări.

Thefts from motor vehicles (cassette players, mirrors, tires, etc.) shall be reported at the police station in whose jurisdiction the theft occurred.

Documents required for the finding:

Identity card / identity document of the insurant or of the delegate (of the Lessor);

Certificate of registration of the stolen vehicle - in original;

Identity card of the stolen vehicle - in original;

Copy of the CASCO policy / certificate or knowledge of the number and series of the insurance policy / certificate;

Certificate from the police certifying the occurrence of the theft - in original; this can be submitted after the theft was reported at UNIQA Asigurări, as soon as it was released by the police;

Power of Attorney / Mandate in case the owner cannot be present at the finding;

All the keys of the stolen vehicle, declared when the insurance policy was taken out.

The mentioned documents represent the prerequisite for opening the damage file; UNIQA damage inspectors may request additional documents on a case-by-case basis after the finding, to complete the file.
